Terms of Service

Agreement
By creating an account or using Perpetua (“the Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service.
Perpetua is currently in private beta. Access is by invitation only and features may change, be added, or be removed without notice.
Who may use Perpetua
You must be at least 18 years old to create an account. By using the Service you confirm that you meet this requirement.
If you are creating a legacy profile on behalf of another person (for example, a deceased family member), you confirm that you have the right to upload and share their personal stories and images.
What Perpetua is
Perpetua is a platform that allows people to record their own voice, stories, and memories. From those recordings, an AI persona is built that others can converse with.
The AI persona is a digital representation generated by artificial intelligence. It is not the actual person. Responses are produced by a language model and may be inaccurate, incomplete, or inconsistent with what the real person would have said.
Perpetua is not a grief counselling service, a mental health tool, or a substitute for professional support. If you or someone you know is struggling with loss, please seek appropriate professional help.
Your content
You own the recordings, photos, and information you upload to Perpetua. By uploading content, you grant Perpetua a limited licence to store, process, and use that content solely to provide the Service — including transcribing your audio and building your AI persona.
You are responsible for ensuring that any content you upload does not infringe the rights of others and does not contain illegal material. You must not upload recordings of third parties without their consent.
We do not sell your content or use it for advertising. See our Privacy Notice for full details of how your data is handled.
Sharing your legacy
You can share a link that allows others to converse with your AI persona. Anyone with that link who creates a Perpetua account will be able to access your persona.
You are responsible for deciding who you share your link with. If you share a link publicly, anyone may access your persona. You can stop sharing at any time by contacting us.
Acceptable use
You agree not to use Perpetua to:
- Impersonate a living person without their consent
- Upload content that is defamatory, harassing, or illegal
- Attempt to reverse-engineer, scrape, or copy the Service
- Circumvent usage limits or security measures
- Use the Service in any way that could harm other users or third parties
We reserve the right to suspend or remove any account that violates these terms.
Service availability
As a beta product, Perpetua is provided “as is” without guarantees of uptime, availability, or data retention. We will do our best to keep the Service running and your data safe, but we cannot guarantee uninterrupted access.
We may update, suspend, or discontinue the Service at any time. If we intend to discontinue the Service permanently, we will give beta users at least 30 days’ notice and an opportunity to export their data.
Limitation of liability
To the fullest extent permitted by law, Perpetua is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including emotional distress arising from interactions with an AI persona.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. During the beta period, where the Service is free, this limit is €0.
Termination
You may delete your account at any time by emailing thorvaldursk@gmail.com. We will remove your data within 30 days.
We may terminate or suspend your account if you breach these terms. We will notify you unless doing so would cause harm to others or is prohibited by law.
Governing law
These terms are governed by the laws of Iceland. Any disputes will be subject to the jurisdiction of the Icelandic courts.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify beta users by email before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
